The California Healthy Youth Act
California Assembly Bill 329 aka The California Healthy Youth Act, is the first time an education curriculum has been mandated by the State Government through law, rather than developed by the California Department of Education through Content Standards and Curriculum Frameworks.
Since when do we allow political activists to write education curriculum?
This is a NEW! Concept
AB329 was authored by Assemblymember Shirley Weber (D- San Diego) and sponsored by the ACLU of California, California Latinas for Reproductive Justice, Equality California, Forward Together and Planned Parent Affiliates of California. Not one single educator presented this curriculum.
The California Department of Education, the County Boards of Education, and school districts across the state are struggling to comply with the law that took effect January 2016. Parents are just learning about this now.
Democrat Shirley Weber is also the author of AB 931; which was introduced this week, and would limit the use of deadly force by law enforcement.

Teaching Comprehensive Sexual Health Education in Public Schools is a "NATIONAL POLITICAL AGENDA" put forth by Planned Parenthood and PFLAG (formerly known as Parents, Families, and Friends of Lesbians and Gays). What is unique to California, is that THE CALIFORNIA LEGISLATURE SPECIFICALLY WROTE THE LAW TO LIMIT PARENT RIGHTS- no other state has done this.
Education Code section 51932(b) specifically states that a parents right to OPT OUT of instruction does not apply to:
"instruction, materials, presentations, or programming that discuss gender, gender identity, gender expression, sexual orientation, discrimination, harassment, bullying, intimidation, relationships, or family and do not discuss human reproductive organs and their functions."
Under "Local Control" the State has held that California State Content Standards and Curriculum Frameworks are a "recommendation" not a "requirement". The local school district- school and individual classroom teacher determine content and instructional time.
Areas of study in grades 1-6 are defined by EdCode Section 51210 and include:
English - Math- Social Science- Science- Visual and Performing Arts - Health (including instruction in the principals and practices of individual, family, and community health) - Physical education.
Areas of study in grades 7-12 are defined by EdCode Section 51220 and include:
English - Social Science- Foreign Language - Physical Education Science - Math - Visual and Performing Arts - Applied Arts- Career Technical Education - Automobile Driver Education. There is no State required Health as a "course of study" aka a "class".
It is the implementation of a State law that makes gender, gender identity, gender expression, sexual orientation, discrimination, harassment, bullying, intimidation, relationships, and family the only state mandated curriculum besides the state mandated 200 minutes of PE. See: CCSS FAQs #5
CALL TO ACTION 2: Parents should demand that CUSD remove health as a class required for graduation.
CUSD made a district decision to make Health a "class" required to graduate. A lot of the offensive content of Teen Talk and similar curriculums could be avoided by eliminating Health as a graduation requirement. If Health were eliminated as a CUSD graduation requirement, CUSD could offer instruction in gender, gender identity, gender expression, sexual orientation, discrimination, harassment, bullying, intimidation, relationships, and family (minus the sexual content) one time (10 hours) in middle school, and one time (10 hours) in high school. When Districts "CHOOSE" to make Health a full class required for graduation, the law forces Districts to teach a larger volume of content. The law also makes this a gateway to teach this curriculum in every grade including elementary school.
Parents and the Public School Curriculum: Do Parents have a legal constitutional right to OPT Out of Objectionable Instruction?
The Courts have consistently ruled that Parents have no federal "Constitutional" right to OPT their children OUT of public school curriculum that they personally object to. Parents have a Constitutional right to decide what school their child will attend (public school, charter school, private school, or home school). Parents do not have the right to veto curricular decisions made by the State or school officials.
To protect parent rights, many states have passed state laws that give parents the right to OPT-OUT of curriculum that parents consider offensive or otherwise inappropriate, even though they have no constitutional obligation to do so.
Every election provides the Public with the opportunity to elect representatives that value parental choice. California's current leadership has mandated by law that EVERY STUDENT ENROLLED IN PUBLIC SCHOOL MUST RECEIVE INSTRUCTION IN GENDER, GENDER IDENTITY, GENDER EXPRESSION, SEXUAL ORIENTATION, DISCRIMINATION, HARASSMENT, BULLYING, INTIMIDATION, RELATIONSHIPS AND FAMILY WITH NO ABILITY FOR PARENTS TO OPT THEIR CHILD OUT OF THIS INSTRUCTION AS LONG AS THOSE DISCUSSIONS DO NOT DISCUSS HUMAN REPRODUCTIVE ORGANS AND THEIR FUNCTIONS
The five curriculums that have been approved for compliance with the Healthy Youth Act all embed the discussion of human reproductive organs and their functions into these discussions. Therefore, parents should legally have the right to OPT their child OUT of all instruction that discuss human reproductive organs and their functions. Teen Talk was the curriculum CUSD chose. CUSD teachers who reviewed the material refused to teach what they felt was a curriculum that was not age appropriate, not medically accurate and was designed to induce children into sexual conduct that was harmful to them physically and emotionally.
CALL TO ACTION 3: Demand that CUSD provide a curriculum that is "age appropriate" and "medically accurate".
The following districts have designed their own curricula to meet California law and health standards and the needs of their students. They have generously offered to make themselves available as a resource for others.
Beyond the national political agenda behind Comprehensive Sexual Health Education is a financial agenda... the collection of personally identifiable student data.
Parents need to understand that your child's privacy rights are no longer protected in Public schools.
On December 10, 2015, by Executive Action, President Obama singed the Every Student Succeeds Act (ESSA).
At the same time the Department of Education amended the Privacy Act of 1974 (FERPA), a Federal Law that protects the privacy of student education records. FERPA has been amended to allow private for profit education companies to have access to students personally identifiable data without parent consent.
The Federal Government also created a pilot program "System of Records- Impact Evaluation of Data- Driven Instruction Professional Development for Teachers".
Collecting the personally identifiable data of every child in public school, from pre-school to adult would allow the Federal Government to build a file on every person in the United States that would eventually include social, emotional, health and sexual data.
I have reason to believe that CUSD was part of this pilot program because they have made curriculum decisions that have not been in the best interest of educating students, but were made to facilitate data collection. CUSD Student data has been continually collected through surveys, personality tests, walk through tools and the implementation of Multi-tier System of Support that have grown out of the adoption of ESSA.
CUSD was the only local school district that required CCP and Health to graduate. Making CCP and Health graduation requirements uses one entire class block for a full year in 9th grade, and is the main reason why CUSD students fall behind on their A-G completion rates limiting their ability to get into a four year selective college or university. CUSD A-G Completion Rate is 53.7%.
Naviance was originally a platform designed to help students with their college applications. Naviance is now used in all grades K-12 to collect student data.

Naviance is now being expanded to elementary schools. Naviance for Elementary School helps ensure equal exposure to college knowledge and career pathways for all students. Help students understand who they are, discover unique paths, and develop the skills to be successful in school and beyond.
Naviance uses personality surveys and career assessments to collect student data. This type of personally identifiable data has always been protected under privacy laws, but no longer.
CUSD made the decision to expand CCP and Naviance. CUSD embedded Naviance into CCP and other classes that were required for graduation so that students had no ability to OPT OUT. See: CUSD Board Study Session: CUSD High School Graduation Requirements:

Embedding offensive curriculum into required course work is done to prevent students from opting out of data mining. CUSD was an early adopter of Comprehensive Sexual Health Education and CHOSE to keep health as a stand alone class required to graduate so that CUSD could collect the social, emotional, sexual and health data of students.
CUSD has an application that allows anyone to collect CUSD student data for a price. The District is usually paid for this data in the form of grants.
Parents should be aware that Trustee Lynn Hatton- Hodson owned a company InnovateEd. InnovateEd is a partner in LCAPca.com which was created by ACSA (the Association of California School Administrators) and is powered by a company named Progress Advisors. Progress Advisor is a company that designs Walk-Thru and Formal Observation Software for Schools and Businesses.
All children deserve a quality education which at a minimum should be District funded state mandated minimum core curriculum. CUSD students no longer receive art, music or science unless parents fundraise for it.
Who is paying for Comprehensive Sexual Health Education and training?

And Why is the ACLU threatening to sue any school district that fails to comply with AB329?

The Federal Government, under the O'Bama administration implemented a plan to organize a "union of all unions" in every State. The chart below illustrates some of the links. When I first started researching these connections ACSA (Association of California School Administrators) was the lead for the State of California's plan to align all parties to the same side of the bargaining table including school board Trustees and the PTA. The Goal - to make a single voice "for the children".
That voice now represents writing legislation such as the Nationwide Comprehensive Sexual Health. The first curriculum that was implemented by a law with curriculum being written by political activists and the muscle was the ACLU who threatens to sue any school district that refuses to comply with the law they sponsored. AB329 was authored by Assemblymember Shirley Weber and sponsored by the ACLU of California, California Latinas for Reproductive Justice, Equality California, Forward Together and Planned Parent Affiliates of California.
Now the ACLU just announced that it plans to sue the City of Los Alamitos for voting to exempt themselves from California's sanctuary state law.
So let me get this straight... the ACLU determines what laws must be followed and what laws can be ignored?
