Comprehensive Sexual Health Education

AB 329 went into effect January 1, 2016.

"Approved" curriculums were written and available to pilot by January 1, 2016. Approved by whom? Not the California Department of Education.

Approved Comprehensive Sexual Health Education Curriculums

In addition, all kinds of books pre-k through Grade 12 were being written and used throughout the state in classroomms prior to any conten standards and curriculum frameworks being approved. For 3 1/2 years this has been oging on with no oversight from the California Department of Education. Under "Local Control", districts could choose to use whatever materials they wanted  in all grades pre-K - Grade 12.

After-the fact, the California Department of Education begins work on the Content Standards and Curriculum Frameworks for Comprehensive Sexual Health Education; having a three year timeline, 2016-2019. 

Content Standards and Curriculum Frameworks were finally adopted on May 8, 2019.

My District (Capistrano Unified) approved their Teen Talk Pilot on December 14, 2016 without any public in-put. The teachers that were being trained to teach the pilot alerted CUSD parents that they did not want to teach Teen Talk because they felt the curriculum was not medically accurate, not age appropriate and actually encouraged students to engage in activities that could harm them. If these teachers had not spoken up, the curriculum would have been fully implemented without any public in-put.

During the period 2016-2019, schools accross the nation began introducing "Comprehensive Sexual Health Education" through anti-bullying programs and instruction on gender, gender identity, gender expression, sexual orientation, discrimination, harassment, bullying, and intimidation. Although AB 329 only mandated instruction in grades 7-12, California schools were teaching these "anti-bullying" programs in all grades pre-K - 12. They were using materials that had never been reviewed or recommended by the CDE.

Parents in CUSD formed UP United Parents and spent over a year trying to work with CUSD to amend the curriculum to comply with AB 329, but ensure that the curriculum was medically accurate and age appropriate. They sought to elliminate any instruction that would encourage children to engage in behaviors that could harm them. Skip Hellewell, one of the founders of UP summerized what UP accomplished.

Comprehensive Sexual Health Education was not brought before the County Board of Education until April 2018, two years after the law went into effect. The Orange County Superintendent of public instruction had districts pilot and begin implementation of AB 329 without the approval of the OCDE Board of Trustees. 

Parents and the public attended the April 11, 2018 OCDE meeting and read from the curriculums in an effort to inform Trustees about what was being taught in Orange County Schools.

Because both the OCDE Board of Trustees and the OCDE Superintendent are "elected", the Superintendent can act on his own without Board approval. That is how Orange County school districts were able to implement pilot programs without public input. 

Parents formed a statewide group called Informed Parents of California in an effort to stop AB 329.

Conclusion:

California has a law AB 329 that was written by the ACLU and political activist groups who bought access to public school children. And, the ACLU (co-author of AB 329) threatened to sue any district that failed to implement AB 329. 

This is how the PUBLIC became aware of what was being taught to their children in public school.

This is not how "State Mandated" education curriculum should be written and implemented.

To ensure this does not happen again, Orange County Voters need to make the OCDE Superintendent an appointed position so that the OCDE Superintendent is accountable to the Board of Trustees and cannot act alone to implement programs and policy behind closed doors.

The California Collaborative for Educational Excellence (“Collaborative”) was established by the California Legislature in 2013 to help school districts implement the State's new funding law, the Local Control Funding Formula and the State's new accountability program LCAP.

The CCEE should be watched. Through Board Policy, the Capistrano Unified School District was giving CCEE the power to revoke charter schools without the right to appeal the revocation. At that time; 2016, the legislation that created the CCEE did not give the CCEE the authority to be the final arbitur of Charter Schools. However, the CCEE was going to be used by anti charter districts to supress school choice by rewriting their Board policies.

It is obvious that CUSD was a very early adopter of this pilot- maybe the first.

It is important to note- that there is no evidence that the Teen Talk 7th and 8th grade curriculum was ever read by the IMRC (Instructional Review Committee) prior to Trustees adopting this Pilot. The Agenda Item did not contain any materials for the Public or Trustees to review.

The one area of content not already included in the code is related to “early warning signs” of abuse. Accordingly, staff recommends that the bill be amended to strike the current language and instead add create a new line within Section 51934 which requires that instruction include “Information on adolescent relationship abuse and intimate partner violence, including the early warning signs of thereof.”

"Human trafficking refers both to sex trafficking and labor trafficking. Amending the California Healthy Youth Act to broaden sex trafficking to human trafficking would accomplish the author’s goal of mandating instruction in this topic, while including it in an already mandated part of the curriculum, and would incorporate established requirements related to parental consent, qualifications and training of personnel delivering the instruction, and would provide for the natural integration of this content into the Health curriculum framework in the appropriate grades. For these reasons, staff recommends that this bill be amended to move the section proposed to be amended into the California Healthy Youth Act, broadening “sex trafficking” to “human trafficking,” and modifying existing law to conform to the requirements of that Act."

State Schools Chief Tom Torlakson Announces Public Comment Period Open for New Health Education Framework

SACRAMENTO—State Superintendent of Public Instruction Tom Torlakson announced today that the public comment period is now open for the Health Education Framework for California Public Schools, Kindergarten Through Grade Twelve. It presents an approach to health education that focuses on students learning skills and practicing behaviors that will lead to a lifetime of good health.

“Students who are healthy do better in school, attend more days of classes and are ready to learn,” said Torlakson. “This new framework is another example of how California is leading the way for comprehensive health education for all students.”

The framework provides guidance on a wide range of health education topics, including nutrition, physical activity, community health, drug use, depression, obesity, relationships, and the impact of the environment on health. It also gives students the tools to reduce risky behaviors. The new health education framework is the first based on the groundbreaking Health Education Content Standards for California Public School, Kindergarten Through Grade Twelve (PDF), which addresses the physical, mental, emotional, and social aspects of health.

The public will have until June 29, 2018, to review the draft framework on the CDE Health Education Curriculum Framework Web page. Public comments will be presented to the Instructional Quality Commission for review and possible inclusion into the final version of the framework this summer.

SACRAMENTO—California is in the final phase of updating its comprehensive health education curriculum framework and is actively gathering public comment on the current draft of the 2019 “Health Education Framework for California Public Schools, Kindergarten through Grade Twelve” (Health Education Framework), State Superintendent of Public Instruction Tom Torlakson announced today.

The Health Education Framework is a groundbreaking document that reflects recent changes in California Education Code and is responsive to the health concerns and needs of today’s 21st century student. The Health Education Framework will provide guidance for teachers, administrators, and parents on how a curriculum based on content standards is implemented in the classroom and direction for the development of instructional materials, curriculum, instruction, assessment, and professional learning.

The current draft Health Education Framework was posted on the California Department of Education (CDE) website on November 1, 2018, and includes more than 200 edits that were submitted by the public during the first 60-day public review and comment period. Each comment submitted by members of the public will be presented to the Instructional Quality Commission for review and possible inclusion into the final version of the framework during their meeting in March 2019. The State Board of Education is scheduled to take final action on the framework in May 2019.

The draft Health Education Framework has been posted on the CDE Health Education Curriculum Framework web page. I would like to give a shout out to UP UnitedParents.org for all of their hard work working with the Capistrano Unified School District to protect students from a medically inaccurate, age inappropriate comprehensive sexual health education curriculum:

With the 2/27/19 Capo USD board meeting, UP finished their one-year fight for a better sex ed curriculum. 

What UP has accomplished:

1.  We stopped Teen Talk, a horrible curriculum, which no other school district has stopped to my knowledge.  At least we stopped 90% of Teen Talk because some of the less offensive material is used in our curriculum.  

2.  Parents will be talking to their kids in more detail about sex.  Our initiative to involve parents in the teaching of sex ed was a complete success.  There will be discussion questions for child and parent to work on for each lesson and these will be well publicized to the parents.  This also informs parent on what is being taught and prompts them to teach their  values to their children.  Moving this teaching of values into the home for each lesson is a giant accomplishment that wouldn't have happened without our pushing.  

3.  Our 22 recommended changes to improve the curriculum made a big difference including these additions in the addendum: a)  improved communication to parents of the student-parent homework talks, b)  A better opt-out process, c)  Instruction to students re communicating to parents, d)  more emphasis on friendships and less on romantic relationships, e)  Removal of the definition of SOGIE (acronym for sexual orientation, gender identity and gender expression), f)  CDC recommendations for pre-natal care to counter the abortion info, g)  more accurate info on harm of HIV/AIDS and risk of HIV transmission, h)  more content on ways to have healthy relationships based on mutual respect and affection (basically our request to teach you can have fun without sex),  i) teaching that 18 is the legal age of consent (consent was taught without mentioning kids can't give it), j)  more teaching of boundary setting and refusal skills,  k)  move "Lesson 11 Liking and Loving" which is more about abstinence to the place of Lesson 12 to finish with a positive message.   Overall we got about half of the changes we asked for, but the more important half in they're well implemented.  

4.  The addition of information on the harms of pornography.   This was the result of the middle school and high school kids who spoke to the trustees; their innocence had a big influence.  I was so proud of our youth and they'll long remember the role they played.  

5.  We created a widely-recognized organization "UnitedParents.org."  This was an important platform for informing people and getting our message out and will have future uses.  Thank you Deb.

6.  We informed thousands of parents in and outside of our district on the evil their children will hear in school.  When we started parents didn't know anything.  An informed public is a critical strength. 

7.  We provided help and motivation to parents in other Orange County areas to influence decisions in their school districts.  Yesterday we learned that the Chino Unified School District is going to create their own sex ed curriculum.  All the local districts have followed our fight with interest and we've proven parents can make a difference.  We have requests for more town-hall meetings.  

8.  We learned how to have an influence in local government.  We were not silent, we spoke up for good.  We made a difference, one that will grow with time.  

9.  We met some really good people across Orange County as well as up and down our state.  The benefits from this will continue.

We should teach tolerance - but we do not mandate "Opt Out" classes to cater to a group that makes up less than 7% of the population. Under "Local Control" California no longer mandates math that aligns with minimum content standards and curriculum frameworks". But we are going to mandate that every student comply with this and parents are forced to "OPT OUT" not "OPT IN"?

Common Core State Standards (CCSS) answers to frequently asked questions (FAQs).

The California Education Code (EC) mandates the adopted course of study for grades one through twelve. ECSection 51210 states that the adopted course of study for students in grades one through six shall include instruction in the following areas of study:

  • English, including knowledge of, and appreciation for, literature and the language, as well as the skills of speaking, reading, listening, spelling, handwriting, and composition.
  • Mathematics, including concepts, operational skills, and problem solving.
  • Social sciences, drawing upon the disciplines of anthropology, economics, geography, history, political science, psychology, and sociology, designed to fit the maturity of the pupils. Instruction shall provide a foundation for understanding the history, resources, development, and government of California and the United States of America; the development of the American economic system, including the role of the entrepreneur and labor; the relations of persons to their human and natural environment; eastern and western cultures and civilizations; contemporary issues; and the wise use of natural resources.
  • Science, including the biological and physical aspects, with emphasis on the processes of experimental inquiry and on the place of humans in ecological systems.
  • Visual and performing arts, including instruction in the subjects of dance, music, theatre, and visual arts, aimed at the development of aesthetic appreciation and the skills of creative expression.
  • Health, including instruction in the principles and practices of individual, family, and community health.
  • Physical education, with emphasis on physical activities for pupils that may be conducive to health and vigor of body and mind, for a total period of time of not less than 200 minutes each 10 school days, exclusive of recesses and the lunch period.
  • Other studies that may be prescribed by the governing board.

Every school in California is required to provide instruction in the subjects named above, although physical education is the only subject that has statutorily required minutes of instruction. The schedule of the instructional day and week is determined by the teacher and the local school and district administration.

California is supporting local implementation of the CCSS through resources available to all LEAs, many of which are noted in the Common Core State Standards Systems Implementation Plan for California. While implementation of specific academic content standards is a local decision and not specifically mandated by EC, California strongly recommends their local use. Statewide assessments which are mandated by EC are based upon California’s adopted academic content standards. Per EC Section 52060, one of the state priorities that must be addressed in each LEA’s Local Control and Accountability Plan is the implementation of the academic content and performance standards adopted by the SBE. In addition, California has distributed $1.25 billion of Common Core State Standards Implementation Funds to support local implementation of SBE-adopted standards. Local governing boards should consider all of these factors and consult local board policy when making decisions regarding local adoption and implementation of academic standards.

The approved curriculums for Comprehensive Sexual Health Education were presented to the County Board of Education on April 11, 2018. Members of the Public took turns reading instructional materials to the Board and pointed out information that was not medically accurate or age appropriate.

UCLA Study reveals that more than 1/4 of California students between the ages of 12 - 17 now identify themselves as gender non-conforming.

The number of adults that identify as transgender (gender does not match the sex they were assigned at birth) has doubled in the last 10 years from 0.3% to 0.6%.

It appears that less than 1% of the population is "born" transgender. In a flawed attempt to teach tolerance for a very small minority of the population, California has succeeded in confusing 26% of children 12-17 years of age who now identify themselves as gender non-conforming. 

Reseach has shown that transgender and gender non-conforming teens have more physical health issues, engage in more risky behaviors and have greater long-term mental health issues.

So why does California want to encourage gender confusion? 

Shouldn't parents have the right to protect children from instruction that could increase the likelyhood that they will engage in risky behaviors which may result in physical and mental health issues? 

This debate should have happened before AB 329 was ever passed into law.

THE OPT OUT LANGUAGE IS INTENTIONALLY CONFUSING

Parents can Opt Out of "Comprehensive Sexual Health Education"

Parents can Opt Out of "Comprehensive Sexual Health Education" which is defined as instruction "regarding human development and sexuality, including education on pregnancy, contrception, and sexually transmitted infections". 51931(b)

Parents cannot OPT OUT of Instruction on Gender Identity

You cannnot OPT OUT of "instruction", materials, presentations, or programming that discuss gender, gender identity, gender expression, sexual orientation, discrimination, harassment, bullying, intimidation, relationships, or family and do not discuss reproductive organs." Ed Code 51932(b)

When instruction embeds graphic sexual content into topics related to gender, bullying and sexual orientation, a parent cannot OPT their child OUT of the instruction.

The problem is the text books on these subjects (which are now embeded in all subject areas) contain the content that many parents feel is not "age appropriate" or "medically accurate". Textbooks are being rewritten to embed gender identity into all subjects...  science, history, english, social studies and on and on.

The text books and curriculums that are now being approved are not in compliance with the law because they show descriptions or illustrations of human reproductive organs, and teach stdents how to engage in varying sexual activity which violate the spirit of the law regarding parental rights to OPT OUT (Ed Code 51932)

This "political movement" is not about promoting healthy lifestyles for children. The approved curriculums are not "medically accurate" nor are they "age appropriate". Many of the instructional materials provide instruction that encourages and teaches students how to engage in risky behaviors that can actually harm them.

Why is OCDE just discussing AB 329 two years after the law went into effect? I attended the April 11, 2018 OCDE Board of Trustees meeting and that Board had never heard of AB 329 before. It appears that the OCDE Superintendent AL Mujares started the implementation of AB 329 on his own, without Board approval. Come to find out, the Superintendent is an elected official. He does not work under the direction of the Board of Trustees, and as such does not need Board approval to act. So what is the point of having a Board of Trustees at OCDE? As an example of how bad legislation is enacted without Board approval see: CUSD to Join California's War on Charter Schools.

Note: CUSD approved it's Pilot for Teen Talk on December 14, 2016. The Instructional Review Committee had never seen the curriculum, and no supporting documentation was in the Agenda Item. No Public review at all.

CONCLUSION

In Summary, the California Healthy Youth Act does not allow a parent to excuse their child from instruction that discusses gender, gender identity, gender expression,and sexual orientation, when the disucussion does not discuss reproductive organs and their functions. In addition, the courts have held that parents do not have the constitutional right to override the determinations of the state legislature or the school district as to what information their children will be provided in the public school classroom.

Maybe it is time to defund Public Education at the State Level and go back to smaller "locally funded" districts where the People will have a say in what their children are being taught.

 

The California Legislative Process is Broken

In Orange County we elect both the Orange County Superintendent of Public Instruction and the Orange County Department of Education Board of Trustees. As such, the Board has no real authority over the Superintendents actions. 

Statutory Functions of County Boards of Education & County Superintendents of Schools.

I. GOVERNANCE

"The county superintendent and the county board of education have separate duties and responsibilities. This is true whether the superintendent is separately elected, as in most counties, or appointed by the board, as in a few counties.

County superintendents of schools are established pursuant to Section 3, Article IX of the California Constitution and are considered county officers (similar to a sheriff, district attorney, or clerk). (Gov. Code § 24000.) County boards of education are established by Education Code section 1000. The interaction between the county board and superintendent is entirely distinct from the relationship of a school district governing board and its employed superintendent.

The county superintendent works directly with the school districts in the county to provide support and guidance for their operations. Policy determinations regarding school districts are made by the superintendent and the local school boards. The county board of education does not have a role in determining the policies of local school districts.

A wide variety of practices and policies have developed in the different counties to enable the county board and county superintendent to work cooperatively. In those counties where both offices are duly elected, each is directly accountable to the electorate. Open communication and mutual sharing of information facilitate the respective functions of the county superintendent and the board."

Under Governor Brown, the State of California began modeling its public education system after Michael Fullan's Canadian model of education. State Superintendent of Public Instruction, Tom Torlakson developed "The California Way" beginning with "A Blueprint for Great Schools". 

The State set up a back channel bureaucracy made of the California Collaborative for Excellence in Education, the Education Coalition and the CDE Foundation to implement their vision in record speed. This public/private partnership developed programs like California Common Core, California's Local Control Funding FormulaCalifornia's Local Control Accountability Plan and the California Healthy Kid Survey.

Behind closed doors, this back channel bureaucracy began working with political advocacy organizations to draft AB 329 Comprehensive Sexual Health Education building on the California Healthy Kids Survey.

It is administered to students at grades five, seven, nine, and eleven. It enables schools and communities to collect and analyze data regarding local youth health risks and behaviors, school connectedness, school climate, protective factors, and school violence. The CHKS is part of a comprehensive data-driven decision-making process on improving school climate and student learning environment for overall school improvements."

State Superintendent Tom Torlakson's A Blueprint for Great Schools, The Education Coalition and the people and entities behind the CDE Foundation drive education policy in the State of California. They do so through a back channel that provides almost no opportunity for public input.

That is how bad laws and politically motivated curriculum are implemented with no oversight.

The laws are passed before the public can see what these laws actually do. 

AB 329 was signed into law effective date January 1, 2016. The debate over curriculum content is just starting today in 2019 (three years after the law went into effect).

The CDE approved the California Content Standards and Curriculum Frameworks on May 8, 2019, 3 1/2 years after the schools began teaching curriculums written by political activists in 2014-15 and 2016.

Political activists should not be dicting education policy, or writing California state laws.

Political activists should not be writing education curriculums behind closed doors.

All of these organizations are political advocacy organizations. These organizations use our public education system to promote political agendas that may not be in the best interest of educating children, and may actually cause harm to children.

It should be noted that while Comprehensive Sexual Health Education is a "national curriculum", California was the only state that mandated no student could OPT OUT of:

"instruction", materials, presentations, or programming that discuss gender, gender identity, gender expression, sexual orientation, discrimination, harassment, bullying, intimidation, relationships, or family and do not discuss reproductive organs." Ed Code 51932(b)

There was no real opportunity for the Public to become informed about what was actually going to be taught because there were no content standards and curriculum frameworks for AB 329 curriculum that were available during the legislative process for the public to review. The curriculums were being written by activist organizations behind closed doors.  When the curriculums were finally made public beginning in 2016, it became obvious that this was not about bullying and teaching tolerance and inclusion of the LGTBQ community.  The curriculums were designed to promote a progressive political agenda- gender confusion under the goal of teaching tolerance and acceptance of pedofiles with the ultimate goal to be the decriminialization of the sexual exploitation of children using the LGTBQ community.

The curriculums were not "state approved", they were not "medically accurate", not "age appropriate" and actually encouraged children of all ages to engage in risky behaviors that might actually harm them.

                       These curriculums were written and ready to go by January 2016,                       without any input from the California Department of Education

In addition, all kinds of books pre-k through Grade 12 were being written and used throughout the state in classroomms prior to any conten standards and curriculum frameworks being approved. For 3 1/2 years this has been oging on with no oversight from the California Department of Education. Under "Local Control", districts could choose to use whatever materials they wanted  in all grades pre-K - Grade 12.

School districts across California have been teaching Comprehensive sexual health education/"gender spectrum" in all grades K-12 for years now without any guidance from the California Department of Education.

The California Department of Education had no involvement.

The Assembly Appropriations Committee reviews all bills with any fiscal impact after passage by a policy committee. The committee hears more bills than any committee in the Legislature. In the 2009-10 and 2011-12 sessions combined, the committee heard about 4,600 bills. For contrast, the Business, Professions and Consumer Protection and Public Safety Committees each referred about 400 bills over the course of these two sessions.

The goal of the committee is sound, responsible, affordable fiscal policy.

For more than 25 years the committee has met every Wednesday morning in Room 4202 during legislative session. Because of the massive workload that crosses all jurisdictional lines, Appropriations operates differently than policy committees. Testimony tends to be more succinct and centers on fiscal implications. The Department of Finance sits at the witness table during hearings to provide the Administration’s official fiscal estimate.

The Appropriations Committee’s Consent Calendar helps the committee expedite passage of noncontroversial bills with minor fiscal impact that receive no dissenting votes in the preceding policy committee, as agreed upon by the Chair and Vice Chair. Another unique feature of the Appropriations Committee is the Suspense File, to which the committee sends any bill with an annual cost of more than $150,000 (any fund). Suspense File bills are then considered at one hearing after the state budget has been prepared and the committee has a better sense of available revenue. No testimony is presented – author or witness – at the Suspense File hearing.

SUMMARY: Makes instruction in sexual health education mandatory, revises human immunodeficiency virus (HIV) prevention education content, expands topics covered in sexual health education, requires this instruction to be inclusive of different sexual orientations, and clarifies parental consent policy.

The Senate amendments:

1) Delete a requirement to provide in-service training on comprehensive sexual health education in addition to HIV prevention education, and state instead that a school district may expand HIV in-service training to cover the topic of comprehensive sexual health education in order for school district personnel who provide this instruction to learn new developments in the scientific understanding of sexual health.

2) State that the requirements of the California Healthy Youth Act do not apply to descriptions or illustrations of human reproductive organs in textbooks if the textbooks do not include other elements of comprehensive sexual health education or HIV prevention education. This would replace a requirement in current law that applies only to textbooks in specific disciplines (physiology, biology, zoology, general science, personal hygiene, and health).

3) Add chaptering out provisions.

EXISTING LAW:

1) Permits school districts to provide comprehensive sexual health education, and places a number of requirements on districts choosing to provide that instruction. Among, these requirements, instruction must be age appropriate, medically accurate and objective, teach respect for committed relationships and marriage, encourage students to speak with their parents or guardians about human sexuality, be appropriate and accessible for use with students with disabilities, and be appropriate for students of all races, genders, sexual orientations, and ethnic and cultural backgrounds.

2) Requires school districts to provide HIV/Acquired Immune Deficiency Syndrome (AIDS) prevention education, and specifies what is to be included in that instruction. Requires inservice training of instructors providing HIV/AIDS prevention education.

3) Permits instruction to be provided by outside consultants and guest speakers at assemblies and requires that this instruction conform to the requirements for school district instruction.

Instructors from Groups like Planned Parenthood were coming into schools to teach Comprehensive Sexual Health Education without parental notification.

4) States that a parent or guardian of a student has the right to excuse their child from all or part of comprehensive sexual health education, HIV/AIDS prevention education, and related assessments, and requires that parents be notified of this right. 

CUSDWatch Comment

The State of California is the only State that changed it's parental consent law so that parents cannot opt their children out of Comprehensive Sexual Health Education. This is a "national" curriculum, but California was the only State to completely deny a parents right to opt their children out of: 

"instruction", materials, presentations, or programming that discuss gender, gender identity, gender expression, sexual orientation, discrimination, harassment, bullying, intimidation, relationships, or family and do not discuss reproductive organs." Ed Code 51932(b)

CDE's new policy:

"CDE is changing its interpretation of parental consent law. Contrary to significant Legislative history on this issue, the CDE has advised school districts that the law permits them to adopt an "opt in" policy regarding comprehensive sexual health instruction (but not HIV/AIDS prevention education). The CDE has recently informed staff that it is in the process of changing this interpretation, and will be advising that "opt in" policies are prohibited."

FISCAL EFFECT: According to the Senate Appropriations Committee, unknown, but costs likely at least in the low millions (Proposition 98 of 1988) to expand the existing mandate. Costs are minor and absorbable to the California Department of Education. This bill expands what school districts are able to claim as a reimbursable state mandate under the existing mandate, regardless of whether this instruction is already being provided. It also requires school districts to incorporate new components in their comprehensive sexual health and HIV prevention education programs, or create a comprehensive sexual health program if they do not offer one already. Costs would vary by school district.

CUSDWatch Comment

The Capistrano Unified School District (CUSD) is preceived to be a "wealthy" suburban school district. The District has a low percentage of students who are English Language Learners, receiving Free and Reduced Lunch and/or are in Foster Care.

CUSD chose not to purchase new math books [Algebra II Trig- small number of students]; books that were so old they were out of print. CUSD cited a lack of funds. The discussion was fascinating:

The Williams Act requires Equity in Public Education - all high schools should receive the new text books- not just two.

Interesting Comments by Trustees Gila Jones and Martha McNicholas - "Math has not changed since 2005 so there is no need to buy everyone a new book".

Common Core Math was implemented in 2012-13. This is going from the 7th edition to the 10th edition... nothing has changed? 

Maybe CUSD should stop using text book money for raises so that all students can have the same text book. CUSD has given employees five consecutive years of across the board compensation increases totaling over $150 million dollars.

A Williams Complaint should be filed. 

How is CUSD going to fund an entirly new Comprehensive sexual health curriculum for all students in every grade? Are they receiving Grant money for organizations like Planned Parenthood? Foundations like the CDE Foundation?

No money for math- but lots of money for Sex Education? 

COMMENTS:

Purposes of this bill. The author explains that this bill is intended to address five topics by:

1) Updating the HIV and AIDS prevention education to reflect today's understanding of HIV and AIDS.

2) Ensuring that students are receiving comprehensive and accurate prevention information for HIV, other sexually transmitted infections, and unintended pregnancy, as well as information about local health resources.

3) Clarifying and bolstering existing requirements that instruction and materials be appropriate for students of all sexual orientations and genders.

4) Clarifying the existing passive consent policy for parental consent.

5) Including new language relating to adolescent relationship abuse and sex trafficking, and reinforcing a focus on healthy attitudes, healthy behaviors, and healthy relationships.

Making comprehensive sexual health education mandatory. Current law does not mandate sexual health education, but places requirements on instruction that is voluntarily provided to students. While this instruction is voluntary, research has shown that nearly all (96%) school districts offer a program of sexual health education. In contrast, HIV/AIDS prevention education has been mandated since 1992. This bill proposes to combine sexual health education and the HIV/AIDS prevention education statutes into a single, mandatory program of instruction. Proponents of this bill argue that this bill reflects the way that sexual health and HIV prevention education is actually provided in schools – as an integrated program of instruction. Research has found that 93% of schools teach the two topics as one class.

Compliance problems. A 2011 report from the University of California, San Francisco, titled Uneven Progress: Sex Education in California Schools, found that since the last major reform in this area there have been improvements in instruction, but that there remain problems regarding school district compliance with current law. Among the findings:

1) Twenty-five percent of districts discussed the required topic of emergency contraception.

2) Fifty-eight percent of districts included required information about contraception in middle and high school.

3) Twenty-five percent of districts omitted required HIV prevention topics.

4) Sixteen percent of districts taught students that condoms are not an effective way to prevent pregnancy and transmission of STIs.

5) Nineteen percent of districts reported that birth control methods are mentioned but that most of the instructional time was spent on the benefits of abstinence.

6) Thirty percent of districts addressed sexual orientation.

7) Thirty-seven percent of districts did not provide required teacher training.

8) Thirty-nine percent of districts failed to provide required materials in languages other than English.

9) Twenty-seven percent of districts failed to provide required materials to make content accessible to students with disabilities.

CDE changing its interpretation of parental consent law. Contrary to significant Legislative history on this issue, the CDE has advised school districts that the law permits them to adopt an "opt in" policy regarding comprehensive sexual health instruction (but not HIV/AIDS prevention education). The CDE has recently informed staff that it is in the process of changing this interpretation, and will be advising that "opt in" policies are prohibited.

Because the Orange County Department of Education elects both the Board of Trustees and their Superintendent, the Superintendent does not have to be on the same page as the Board of Trustees. The "back channel" is created when Public/Private Coolaborative instructs the Superintendent to implement the back channel agenda by going directly to the individual school districts (not through the OCDE Board of Trustees). The Superintendent instructs the individual districts to write resolutions in support of specified bills or policies. The Superintendent instructs individual school districts to implement policies, programs and even pilots that the back channel public/private Collaborative support. When that same policy or program is brought to the OCDE Board they often vote in opposition to a law that the Superintendent and the individual districts support.

We need to change the OCDE Superintendent position from an "elected" position to an "appointed" position so that all poicy will flow from the "elected" Board of Trustees to the "appointed" superintendent. 

Statutory Functions of County Boards of Education & County Superintendents of Schools.

I. GOVERNANCE

"The county superintendent and the county board of education have separate duties and responsibilities. This is true whether the superintendent is separately elected, as in most counties, or appointed by the board, as in a few counties.

County superintendents of schools are established pursuant to Section 3, Article IX of the California Constitution and are considered county officers (similar to a sheriff, district attorney, or clerk). (Gov. Code § 24000.) County boards of education are established by Education Code section 1000. The interaction between the county board and superintendent is entirely distinct from the relationship of a school district governing board and its employed superintendent.

The county superintendent works directly with the school districts in the county to provide support and guidance for their operations. Policy determinations regarding school districts are made by the superintendent and the local school boards. The county board of education does not have a role in determining the policies of local school districts.

A wide variety of practices and policies have developed in the different counties to enable the county board and county superintendent to work cooperatively. In those counties where both offices are duly elected, each is directly accountable to the electorate. Open communication and mutual sharing of information facilitate the respective functions of the county superintendent and the board."

  The Capistrano Unified School district Superintendent and Staff run the district, with Trustees working on inaccurate or incomplete information. The CUSD Board has no power and is basically their to rubber stamp what ever comes before them. 

 

Example of How the Back Channel Works  

At the April 25, 2019 CUSD BOT meeting during Trustee comments, Trustee Amy Hanacek asked CUSD Staff to place a Resolution in Support of AB 1505 Charter schools: petitions on the next board meeting agenda.

AB 1505 (as Amended April 24, 2019) would:

Eliminate state approved charter schools: 

The bill would repeal those provisions authorizing the state board to approve a petition to establish a charter school. 

The bill would provide that charter schools operating under a charter approved by the state board may continue to operate under those charters only until the date on which the charter is up for renewal.

Would limit county boards authority to approve charter schools:

The bill would specify that a petition to establish a charter school may be submitted only to the school district or county office of education the boundaries within which the charter school would be located, and would provide that, commencing January 1, 2020, a county board of education could approve a petition for a countywide charter only under specified conditions and pursuant to a specified procedure, including requiring the petitioner to obtain the approval from each of the school districts where the charter school petitioner proposes to operate a facility.

The bill would authorize a county board of education to deny a petition for the establishment of a new charter school if it makes a written factual finding that the charter school would have a negative financial, academic, or facilities impact on neighborhood public schools, a school district, or the county office of education. 

Would effectively place all approval authority over charter schools with the local school district board.

Conclusion: 

This "instruction" has been going on in our public schools for 3 1/2 years.

That is how parents became "informed" about AB 329 Comprehensive Sexual Health Education.

A recent UCLA study revealed that more than 1/4 of California students between the ages of 12 - 17 now identify themselves as "gender non-conforming". 

20.8% identify themselves as Androgynous.

6.2% identify as Highly Gender Nonconforming

The number of adults that identify as transgender (gender does not match the sex they were assigned at birth) has doubled in the last 10 years from 0.3% to 0.6%.

It appears that less than 1% of the population is "born" transgender. In a flawed attempt to teach tolerance for a very small minority of the population, California has succeeded in confusing 26% of children 12-17 years of age who now identify themselves as gender non-conforming. 

Research has shown that transgender and gender non-conforming teens have more physical health issues, engage in more risky behaviors and have greater long-term mental health issues.

So why does California want to encourage gender confusion? 

Shouldn't parents have the right to protect children from instruction that could increase the likelyhood that they will engage in risky behaviors which may result in physical and mental health issues? 

This debate should have happened before AB 329 was ever passed into law.

Why Are So Many Parents Enraged By The New Sex Education Curriculum?

Comprehensive Sexual Health Education is a national curriculum that was initiated by Planned Parenthood in 2010 in coordination with PFLAG, a national organization known as Parents, Families and Friends of Lesbians and Gays. It started as a movement to prevent bullying and to make schools more inclusive and tolerant of kids who are LGBTQ. 

THE PROBLEM:

The State mandated approved curriculums are not "medically accurate" or "age appropriate" and actually encourage children to engage in risky behaviors that can harm them.

Comprehensive Sexual Health Education is being used by political activists to promote a political agenda that seeks to normalize pedophilia and decrimminalize the sexual exploitation of children. 

This debate should have happened BEFORE AB 329 was passed, and the curriculums were approved.

AB 329 Pupil Instruction: Sexual Health Education

In 2015 Shirly Weber (D) authored AB 329 making Comprehensive Sexual Health Education madatory in grades 7-12 as of January 1, 2016. 

The law does not mandate instruction in preschool or elementary school. Any instruction in lower grades is a "Local" choice. 

The bill was co-sponsored by  ACLU of CaliforniaCalifornia Latinas for Reproductive Justice,  Equality CaliforniaForward Together and Planned Parent Affiliates of California

The law was modified by Ed Code Sections 51930  and  51939.

AB 329 requires 10 hours of instruction in Comprehensive Sexual Health Education one time in middle school and one time in high school.

"Health"as a stand alone class is not a California graduation requirement. Any District that is requiring Health as a graduation requirment has "chosen" to do so. It is not mandated by State law. My DIstrict, the Capistrano Unified School District made Health a stand alone class required to graduate so children in this district will have many more hours of Comprehensive Sexual Health than is required by law..

After the law went into effect, the CDE began the process of writing the content standards and curriculum frameworks. 

The public was never provided with an opportunity to reveiw content prior to the law passing. That speaks volumes about its "benefit" to children. This is not how normal curriculums are developed.

Pederasty is a word that I had never heard before I entered the debate about what is "age appropriate" and "medically accurate" for a sex education curriculum in public schools. But here we are. Despite the fact that this law went into effect Januaray 1, 2016, the debate has just begun.

The question is:

Is AB 329 promoting sexual health education and tolerance for the LGBTQ community, or are political activists using our public education system to normallize pedophilia and decriminialize the sexual exploitation of chidren?

Just like Obama Care... CA had to pass AB 329 in order for parents and the public to see what was in it.

The approved curriculums are just now being brought to light. Parents are appaled, and many teachers are refusing to teach the curriculum.  To make matters worse, parents are having trouble opting their children out of curriculum they feel is not "age appropriate" or "medically accurate" and could actually harm them.

The boy’s father would ultimately choose the older man, similarly to a father seeking a husband for his daughter."

Pederasty is erotic homosexual relationships between adult males and adolescent males.

Pedophilia is the desire to have sex with children of any gender, and at any age.

The Argument for "Education"

In April 1972, Jeanne Manford and her husband learned that their son Morty, a gay activist, had been beaten while passing out flyers at the 50th Inner Circle dinner in New York City. Jeanne Manford was incensed that police failed to intervene.

In a April 29, 1972 letter to the editor of the New York Post she recounted the brutal beating Morty had sustained.

In the letter she openly admitted that her son was a homosexual, but that she loved him anyway. 

After the publication of the letter, Morty asked his mother to march with him in the Christopher Street Liberation Day Parade (now known as New York's Gay Pride Parade). Marching side by side with her son, she carried a sign with a single message:

"Parents of Gays Unite in Support for our Children"

The Manford's public support of their openly gay son presented them with an opportunity to begin a support group for parents of gays. The goal was to help other parents facilitate a positive dialogue with their gay children. 

In 1973, Parents of Gays held their first meeting. POG continued to gain support and by the 1980's it became a national organization and changed its name to PFLAG (Parents and Friends of Lesbians and Gays).

Morty Manford died on May 14, 1992 of AIDS at the age of forty-one.  

Jeanne Manford remained a staunch advocate for the LGBT community until her death on January 8, 2013 at the age of 92.

CUSDWatch Comment:

Jeanne Manford's movement to help families accept their gay children was the result of real love and compassion for individuals that were victimized soley because of their "sexual orientation". 

At the heart of the debate over the California's Healthy Youth Act is the question. 

Are we born that way?

No one is responsible for the way they are born.

However, in a civilized society everyone is responsible for their actions.

In general, civilized society seeks to provide special protections for those individuals that, through no fault of their own, are outside of societal norms. Teaching "tolerance" for those who have no say in the way they are born benefits a civilized society. 

On the other hand, one could argue that this curriculum does not teach compassion for individuals that are outside of societal norms.  That, it is in fact motivated by a political agenda that seeks to normalize the sexual exploitation of children on the basis that pedophilia is a natural "sexual orientation". The narative that pedophiles are born that way, and therefore should be given special protections has now become a mainstream conversation in an effort to decriminialize the sexual exploitation of children.

Alfred C. Kinsey 

The Argument Against the Sexual Exploitation of Children

Kinsey, the Father of Modern Day Sex Education and the Father of the Sexual Revolution

Alfred Kinsey used his research to institutionalize the hypersexualization of children.

In 1948 Kinsey published a book entitled "The Sexual Behavior in the Human Male", in which he documented the sexual behavior of men and children as young as 2 months old. He recorded the number of orgasms infants and children were able to have within certain time frames. Kensey encouraged known pedophiles with stopwatches to molest children and record data which he then published in his book. Kinsey used this research to attempt to normalize pedophilia and decriminalize the sexual exploitation of children.

The table recorded orgasms for children as young as 2 months to age 14. One child age 4 was forced to have 26 orgasms in a 24 hour period.

The validity of Kinsey's data is now being questioned. For the male data he went into prisions and interviewed the most sexually devient criminals, and then classified their data as normal for the average male.

In 1953 Kinsey published  a  book entitled "The Sexual Behavior in the Human Female". He collected his data from female prostitutes and classified that data as normal for the average female.

ISR had two primary goals: to continue the team's research on human sexual behavior; and to administer research resources, including research materials, a library, case histories, and other related materials.

PIE 

"Pedophile Information Exchange" 

PIE was a London based advocacy group that existed from 1974 to 1984. The group advocated for the removal of age of consent laws and the normalization of pedophilia. PIE specialized in providing specific lists of places where pedophiles could locate and seduce children.

In October 1978, a member of the public found a package containing a large quantity of child pornography on a public bus. The package was traced to Sir Peter Hayman; a British diplomat and intelligence operative and member of PIE. Geoffrey Dickens, a member of the Brittish Parliment identified him as a pediophile in the House of Commons in 1981. Geoffrey Dickens, had assembled a dossier that included the names of eight promenent figures in the British Government. In 1983 he gave the dossier to Home Secretary Leon Brittan and asked him to invetigate claims of child sex abuse at Buckingham Palace.

The dossier disappeared. No action was taken.

PIE had a membership list that contained more then 307 names and addresses of pedophiles that the police ignored until 2012 when authorities decided to take another look. 

In 2014 Home Secretary Theresa May called for a review of child sex abuse allegations from the 1970s' and 1980s'.

In January of 2015 security expert Dr. Chris Murphy stumbled across a secrete government file that had been under lock and key for 35 years on grounds of national security.

PIE disbanded in 1984 after leaders were prosecuted.

North American Man boy Love

NAMbLA stands for Man Boy Love. The Organization was formed in 1979 as a support group for men that were sexually attracted to boys. NAMbLA also acts as an advocacy organization that works to abolish age-of-consent laws criminalizing adult sexual involvement with minors. The group also campaigns for the release of men who have been jailed for sexual contacts with minors that did not involve coercion.

Wrongful Death Lawsuit

In 1997 Robert and Barbara Curley filed a wrongful death and civil rights lawsuit against NAMbLA and 18 reputed members for the death of their son.

Jeffrey Curley was abducted in East Cambridge after he was lured into a car driven by Salvatore Sicari, and Charles Jaynes. Authorities said the men promised Curley a new bike.

When Jaynes made sexual advances toward the boy, he fought back in a struggle that authorities said lasted about 20 minutes in the back seat. Jaynes subdued and smothered Curley, stuffing a gasoline-soaked rag into his face.

The child's body was sexually assaulted in Jaynes's apartment in Manchester, N.H., before he and Sicari placed their victim in a 50-gallon plastic container, filed it with lime and concrete, and dumped it in a river in southern Maine.

Both men were convicted of murder charges and are serving life sentences.

The lawsuit against NAMbLA was based on allegations that Charles Jaynes was a member of NAMbLA and had obtained materials from NAMbLA which caused him to become obsessed with having sex with and raping young male children.

The ACLU stepped in to represent NAMbLA on First Amendment Issues stating that "In America, there's freedom to publish unpopular ideas, and that's what this case was about."

The Curleys were forced to drop the civil rights suit, but prevailed in the wrongful death suit against the two killers.

"The total number of alleged suspects notified to Operation Hydrant since its inception in 2014 totals 6310. This comprises 5690 males, 427 females and 193 of unknown sex. Where suspects are classified as unknown/ unidentified, this may be for example someone who is identified by profession but not by name.

3323 alleged suspects remain subject to live investigations.

Investigations in relation to 2987 alleged suspects are closed. A closed investigation is any investigation, which has an outcome such as, No Further Action (NFA) by Police, NFA by the Crown Prosecution Service, acquitted, convicted or cautioned.

Within the cumulative figure of 6310 alleged suspects, 1040 are deceased.

291 alleged suspects are classified as Persons of Public Prominence (PPPs). PPP’s are only 4.6% of the total alleged suspects on Operation Hydrant’s database. These include:

  • 91 from TV, film, or radio
  • 63 are listed as politicians (including both national and local)
  • 38 are from the music industry
  • 29 are from the world of sport

The total number of victims on the Operation Hydrant database is 8167, comprising 5786 males, 2370 females and 11 of unknown sex.

3422 different institutions feature on the Operation Hydrant database. These include:

  • 277 Children & young people’s associations & clubs

The Wellcome Trust,  Library  and  Collection together occupy an entire block on the south side of Euston Road, London: two interconnected edifices, comprising the Wellcome Building opened in 1932 by pharmaceutical entrepreneur and philanthropist Henry S. Wellcome, and the Gibbs Building opened in 2004 and named after the then Chairman of the Wellcome Trust, Sir Roger Gibbs.

The archive of the Tavistock Institute of Human Relations was gifted to the Wellcome Trust in 2015. Characterised by a broad and complex psycho-socio-cultural and health coverage, the Tavistock Institute’s archive fits comfortably within the Wellcome Library’s collecting policy and there has already been significant researcher interest in the collection.  It is now one of the Wellcome Library’s 700-plus archive collections which also include the papers of Francis CrickThe Family Planning AssociationMarie StopesMelanie KleinNational Childbirth TrustDonald Winnicott and The Mental Aftercare Association, to name but a very few. It will be preserved in perpetuity in the Library’s environmentally controlled on-site storage on the Euston Road.

Dating back to the 1940s and being of substantial physical proportions the Tavistock Institute’s archive will undoubtedly become one of the Wellcome Library’s ‘whopper’ collections. Tentative predictions are of a total 500-600 archive boxes once it is fully catalogued and re-housed (the latter meaning: packaged in archival quality folders and boxes).

The Tavistock Institute’s Archivist, Elena Carter, seconded by the Tavistock Institute to work in the Wellcome Library, will over the next two years catalogue the collection in detail. One of the ultimate goals of the Archive Project is for researchers and historians to be able to browse the Wellcome Library’s online catalogue, identify material of interest to them, order files online and consult them in the Wellcome Library’s Rare Materials Room.  We are looking forward to a future when anyone interested in the history, influence and work of the Tavistock Institute of Human Relations will be able to consult the organisation’s archives with ease in the Wellcome Library following a mere few clicks of a mouse!

If a foundation is giving grant funding to doctors, scientists, universities and hospitals, it may influence their drug trial results for the pharmaceutical side of the organization. They would be paying for the results they needed to profit from the sale of the drugs they developed.  Welcome's Bactrim-Septra caused sickness, disability and death to so many people that the UK banned its use except in AIDs patients. AZT was approved by the FDA n 1987 in record time, with only one trial on humans instead of the standard three. The trial was stopped after nineteen weeks because death rates of AID's patients were soaring, while drug trials were just beginning. In 1987 50,378 cases of AIDS had been reported to date resulting in 40,849 deaths according to amfAR Foundation for Aids Research.

John Lauritsen claimed that:

"Those who have eyes to see are witnessing genocide – the genocide of gay men. Millions of dollars are now being spent on an international advertising campaign, "Living With HIV", in which gay men and other members of "risk groups" are being told: "Get tested for antibodies to HIV [the alleged 'AIDS virus'] – if you 'test positive' you need 'medical intervention' which could 'put time on your side'." The 'medical intervention' is AZT (also known as Retrovir and zidovudine), and the campaign is paid for, directly and indirectly, by Burroughs-Wellcome, the manufacturer of AZT."

AZT Cost $10,000 per patient per year in 1987. 

AZT was not a new drug, Burroughs Welcome had developed the drug decades earlier as a cancer treatment that was shelved as ineffective. 

AZT - was a financial boom for Burroughs Welcome, but it came  at the expense of gay men and "other risk groups".

Kim Noble is a mother, artist and author who has Dissociative Identity Disorder (DID). DID is a creative way to cope with unbearable pain. The main personality splits into several parts each having an amnesic barrier between them. In and out of hospital from the age of 14, with no formal art training, Kim and her alters became interested in painting in 2004 after spending a short time with an art therapist. The resulting 13 artists each have their own distinctive style, colour and themes that they work with. Many are unaware they share a body with other artists. Combined, they have had over 60 exhibitions, nationally and internationally.
Noble was the first Artist in Residence at Springfield University Hospital in Tooting, South West London. Her book 'All of me' was published by Piatkus in 2011. Noble has had many TV and radio appearances, including the Oprah Winfrey Show, This Morning Show, Anderson Cooper Show and BBC Radio1 with Victoria Derbyshire.

“What’s in the emails is staggering and as a father, it turned my stomach,” the NYPD Chief said. “There is not going to be any Houdini-like escape from what we found. We have copies of everything. We will ship them to Wikileaks or I will personally hold my own press conference if it comes to that.”

After this research, it is very clear to me that Comprehensive Sexual Health Education (a national curriculum that was initiated by Planned Parenthood in 2010 in coordination with PFLAG, a national organization known as Parents, Families and Friends of Lesbians and Gays), is not a curriculum that is designed to prevent bullying and to make schools more inclusive and tolerant of students who are LGBTQ.

Comprehensive Sexual Health Education is being used by political activists to promote a political agenda that seeks to normalize pedophilia and decrimminalize the sexual exploitation of children. 

This has no place in America's public education system.

If Jeanne Manford was still alive, she would be heartbroken to see how her fight to teach tolerance and compassion is now being used to harm children.
