CONFERENCE WITH LEGAL COUNSEL – ANTICIPATED LITIGATION Attorney: David Huff Kirsten M. Vital and Clark Hampton Board Audio at 12:09 Trustees gave direction to staff. Board Audio at 12:13 The Board read the following Statement regarding the Toll Road alignment at Tesoro High School. "The Board Met in closed session to discuss anticipated litigation relative to the Los Patrones Parkway construction. As a result of that discussion, the Board expressed concerns for potential health impacts on our students at Tesoro High School and the future Esencia K-8. While our review suggests that these impacts have been considered; out of an abundance of caution the Board has directed Staff to contact TCA and the County of Orange to request written assurances that their projects adequately mitigate any air pollution and noise impacts on our schools by providing us with written evidence that the specific roadway alignments including distances from existing and planned campuses under construction of the Los Patrones Parkway Project and the Oso Bridge Project." |

(NOT SURPLUS PROPERTY) 7.292 acre property located at the north east corner of Camino Las Ramblas and Avenida California Negotiating Party: One or more potential buyers for the Property who may purchase the Property through a request for proposals process: San Juan Capistrano - Pacifica San Juan The District will pursue re-entitlement of the site to allow for both school and/or residential use, in order to preserve flexibility on how this site is used in the future. The District will also explore the feasibility of assigning its rights under the agreement to a third-party developer, who would then purchase the site and develop into residential homes. Any selection of a third-party developer would involve a public RFP and/or pre-qualification process. District staff will involve City staff in the course of moving forward with plans for this site. Property: South Transportation and Groundskeeping Facility. (NOT SURPLUS PROPERTY) 5.51 acre property located at 26126 Victoria Blvd, Dana Point, CA 92624 Negotiating Party: One or more potential buyers or lessees for the Property who may purchase or lease the Property through a surplus property bid auction process Dana Point - South Transportation and Groundskeeping Facility The District will preserve space on the south bus yard site for use by the Grounds and Transportation Departments for surplus storage and vehicle parking. Remaining space on the site will be made available for leasing of RV/boat storage. The District will make improvements to the site for the purpose of leasing space for storage. The District will also explore options for the long-term repurposing of the site. District staff will involve City staff in the course of moving forward with plans for this site.
Property: Paseo de Colinas. (DECLARED SURPLUS PROPERTY IN 2006) 2.47 acre property located on Paseo de Colinas adjacent to Niguel Hills Middle School Negotiating Party: One or more potential buyers for the Property who may purchase the Property through a surplus property bid auction process Laguna Niguel - Paseo de Colinas Property The District will reorganize the Laguna Niguel site adjacent to Niguel Hills Middle School to allow for the more efficient layout of storage. The District will negotiate the amendment of terms on the existing use agreement for storage space with the local car dealership. The District will also explore the option of potentially selling the site. District staff will involve City staff in the course of moving forward with plans for this site. |
