Florida Enacts New Law To Stop School Shootings.

This new is called the “Marjory Stoneman Douglas High School Public Safety Act.”

"The Legislature finds there is a need to comprehensively address the crisis of gun violence, including but not limited to, gun violence on school campuses. The Legislature intends to address this crisis by providing law enforcement and the courts with the tools to enhance public safety by temporarily restricting firearm possession by a person who is undergoing a mental health crisis and when there is evidence of a threat of violence, and by promoting school safety and enhanced coordination between education and law enforcement
entities at the state and local level."

Data Collection - What are the Implications for Individual Privacy and Civil Liberties?

(6) Coordinate with the Department of Law Enforcement to provide a centralized integrated data repository and data analytics resources to improve access to timely, complete and accurate information integrating data from, at a minimum, but not limited to, the following data sources by December 1, 2018:

  • Social Media;
  • Department of Children and Families;
  • Department of Law Enforcement;
  • Department of Juvenile Justice; and
  • Local law enforcement.

(7) Data that is exempt or confidential and exempt from public records requirements retains its exempt or confidential and exempt status when incorporated into the centralized integrated data repository.

(8) To maintain the confidentiality requirements attached to the information provided to the centralized integrated data repository by the various state and local agencies, data governance and security shall ensure compliance with all applicable state and federal data privacy requirements through the use of user authorization and role based security, data anonymization and aggregation and auditing capabilities.

(9) To maintain the confidentiality requirements attached to the information provided to the centralized integrated data repository by the various state and local agencies, each source agency providing data for the repository shall be the sole custodian of the data for the purpose of any request for inspection or copies thereof under ch. 119. The department shall only allow access to data from the source agencies in accordance with rules adopted by the respective source agencies.

Courts will now be required to notify school districts of delinquent acts by students:

"The Court Shall , within 48 hours of the finding, notify the appropriate district school superintendent of the name and address of any student found to have committed a delinquent act, or who has had adjudication of a delinquent act withheld which, if committed by an adult, would be a felony, or the name and address of any student found guilty of a felony, or the name and address of any student the court refers to mental health services. Notification shall include the specific delinquent act found to have been committed or for which adjudication was withheld, or the specific felony for which the student was found guilty."
