USE OF INDIVIDUAL STUDENT RECORD INFORMATION FOR ACADEMIC ACHIEVEMENT DATA DISAGGREGATION

Student Records

The Board of Trustees authorizes the Superintendent or designee to use individual student records pertaining to student eligibility status for participation in any free or reduced-price meal program solely for the purpose of disaggregation of academic achievement data as authorized by Education Code 49558(b). This use is authorized by federal law, in order to meet the requirements of Section 6311(b)(3)(1) of Title 20 of the United States Code which requires disaggregation of test results within each state, local educational agency, and school by economically disadvantaged students compared to students who are not economically disadvantaged.

Confidentiality of Student Records

The Superintendent designates the following District employee(s) to use individual records pertaining to student participation in the free and reduced-price meal program for the purpose of disaggregation of academic achievement data and/or the provision of services under the federal Elementary and Secondary Education Act pursuant to 20 USC 6301-6576.

No individual indicators of participation in any free or reduced-price meal program shall be maintained in the permanent record of any student, no public release of information regarding individual student participation in any free or reduced-price meal program shall be permitted, and all confidentiality provisions required by law shall be met. Additionally, information collected regarding individual students certified to participate in the free and reduced-price meal program is destroyed when no longer needed for its intended purpose. (Education Code 49558)

Specifically, only the staff designated by this policy will use information regarding the eligibility status pertaining to individual students and will use that information solely for the purpose stated in this policy.

Authorization for Release of Information

This use is specifically authorized by the federal statutes governing the school lunch programs (42 USC Section 1758(b)(2)( C )(iv)), and by the Federal Family Educational Rights and Privacy Act (FERPA, Section 1232g(b)(1)( C ) and (b)(3) of Title 20 of the United States Code, Sections 99.31(a)(3) and 99.35(a) of Title 34 of the Code of Federal Regulations), and by Education Code 49076(a)(3).

This data will be provided by the District to the California Department of Education (CDE) or its designated agents to enable the state to make the report required by by federal law20 USC Section 6311(b)(3)(I). CDE or its designated agents will protect the information in a manner that will not permit the personal identification of students and their parent/guardians by other than those officials, and such personally identifiable data shall be destroyed when no longer needed for compliance with this federal legal requirement.
